1. Acceptance of Terms

By creating an account, placing an order, or otherwise using our Platform, you confirm that:

• You have read and agree to these Terms of Service

• You are legally capable of entering into binding contracts
• You will comply with all applicable local, state, and national laws

These Terms constitute a legally binding agreement between you and KostKota. We reserve the right to refuse service to anyone for any reason at any time.

2. Eligibility

To use our Platform, you must:

• Be at least 18 years of age
• Be a resident of Nigeria or have a valid Nigerian delivery address
• Have the legal capacity to enter into contracts
• Provide accurate and complete registration information

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility and refuse service if these requirements are not met.

3. Account Registration

To access certain features of our Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account use

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

4. Products & Ordering

Product Information

We strive to provide accurate product descriptions, images, and pricing. However:

• Product weights may vary slightly from listed amounts (typically +/- 10%)
• Images are representative; actual products may vary slightly in appearance
• Product availability is subject to change without notice
• We reserve the right to limit order quantities

Order Acceptance

Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order is only confirmed when you receive an order confirmation email or notification. We may cancel orders due to pricing errors, product unavailability, or suspected fraud.

Order Modifications

Orders may be modified or cancelled within 2 hours of placement, provided processing has not begun. Contact our support team for assistance with order changes.

5. Pricing & Payment

Pricing

• All prices are displayed in Nigerian Naira (NGN)
• Prices include applicable VAT where required
• Delivery fees are calculated based on your location and displayed at checkout
• We reserve the right to change prices at any time without notice
• Promotional prices are valid for the stated period only

Payment Methods

We accept the following payment methods:

• Credit and debit cards (via Paystack)
• Bank transfers
• Mobile money
• Loyalty points (where applicable)

Payment Security

All payments are processed securely through Paystack, a PCI DSS compliant payment processor. We do not store your full payment card details on our servers.

6. Delivery

Delivery Areas

We currently deliver to select areas within Nigeria. Delivery availability and fees vary by location. Check our Shipping Information page for coverage details.

Delivery Schedule

• Deliveries are made on scheduled delivery days for your area
• Delivery times are estimates and not guaranteed
• Someone must be available to receive perishable goods
• Failed delivery attempts may incur additional fees

Cold Chain Guarantee

All meat products are transported in temperature-controlled vehicles and insulated packaging to maintain freshness. Our products are vacuum-sealed for maximum quality.

7. Group Purchases

Our group purchase feature allows customers to pool orders for better pricing:

How It Works

• Create or join a group in your delivery area
• Groups have minimum and maximum participant requirements
• Pricing tiers unlock as more members join
• Groups have a deadline for reaching minimum requirements

Group Terms

• Payment is collected when you join a group
• If minimum requirements are not met, full refunds are issued
• Group organizers may set additional group rules
• Your first name and general area may be visible to other group members
• Full contact details are never shared with other customers

8. Returns & Refunds

Quality Issues

Due to the perishable nature of our products, we have specific return policies:

• Report quality issues within 24 hours of delivery with photos
• We will replace or refund products that arrive damaged or spoiled
• Refunds are processed within 5-7 business days

Non-Delivery

If your order is not delivered as scheduled, contact us immediately. We will either reschedule delivery or issue a full refund.

Change of Mind

Due to the perishable nature of food products, we cannot accept returns for change of mind after delivery has been made.

9. Intellectual Property

All content on the Platform is owned by or licensed to KostKota, including:

• Trademarks, logos, and brand elements
• Website design, graphics, and layout
• Product images and descriptions
• Software, code, and technical infrastructure
• Blog content and educational materials

You may not copy, reproduce, distribute, or create derivative works from our content without explicit written permission. Limited use is permitted for personal, non-commercial purposes such as sharing product links.

10. User Conduct

When using our Platform, you agree not to:

• Provide false or misleading information
• Use the Platform for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Platform
• Harass, abuse, or harm other users or our staff
• Use automated systems to access the Platform without permission
• Engage in fraudulent transactions or payment disputes in bad faith
• Resell products purchased through our Platform without authorization

Violation of these rules may result in account suspension or termination, and we may pursue legal action where appropriate.

11. Limitation of Liability

To the fullest extent permitted by law:

• Our Platform is provided "as is" without warranties of any kind, express or implied
• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the specific order in question
• We are not responsible for delays or failures due to circumstances beyond our reasonable control

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless KostKota, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of this page
• For material changes, we will notify you via email or prominent notice on our Platform
• Continued use of the Platform after changes constitutes acceptance
• If you do not agree to the modified Terms, you must stop using the Platform

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Nigeria.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
